Mobile Messaging Terms & Conditions and Mobile Messaging Privacy Policy

Effective Date: September 18, 2026

Elect Dem Majority (hereinafter “We,” “Us,” or “Our”) offers a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Mobile Messaging Privacy Policy (the “Terms”).

By opting into or participating in the Program, you accept and agree to these Terms, including your agreement to resolve disputes with Us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. These Terms are limited to the Program and are not intended to modify any other terms and conditions or privacy policies that may govern your relationship with Us in other contexts.

Modification of Terms: We reserve the right to revise these Terms from time to time. Revised Terms will supersede all prior versions. Unless otherwise stated, revisions will become effective on the effective date indicated at the top of these Terms. Updates may be communicated to you by mobile message containing a link to the revised Terms. Your continued participation in the Program after receiving notice of updated Terms constitutes your acceptance of the revisions. If you do not agree to the revisions, you must opt out of the Program.

General Privacy Policy: Except as otherwise specified in these Terms, Our collection and use of information are also subject to Our general privacy policy, available at https://electdem.io/privacy-policy/.

User Opt-In: The Program allows users to receive mobile messages by affirmatively opting in. Regardless of the method you use to join the Program, you agree that these Terms apply to your participation.

By participating in the Program, you agree to receive recurring automated marketing and fundraising mobile messages at the telephone number associated with your opt-in. Consent is not required as a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies.

Although you consent to receive messages sent using automated technology, this does not suggest or imply that any or all of Our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”).

User Opt-Out: If you no longer wish to participate in the Program or agree to these Terms, reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to any mobile message from Us. You may receive one additional message confirming your opt-out request.

You may also request to opt out by emailing info@electdem.io. You understand and agree that these are the only reasonable methods of opting out. Other methods, including texting words not listed above or verbally asking one of Our employees to remove you from the Program, may not be recognized as valid opt-out requests.

T-Mobile and AT&T provide daily files identifying telephone numbers that have been deactivated or ported from one carrier to another. We proactively remove identified deactivated numbers from Our subscription list.

Duty to Notify and Indemnify: If you intend to stop using the mobile telephone number used to subscribe to the Program, including by canceling your service plan or selling or transferring the number to another party, you agree to complete the User Opt-Out process described above before ending your use of that telephone number.

You understand and agree that this obligation is a material part of these Terms. If you discontinue using your mobile telephone number without notifying Us, you agree to be responsible for all costs, including attorneys’ fees, and liabilities incurred by Us or any party assisting in the delivery of mobile messages as a result of claims brought by an individual who is later assigned that telephone number. This duty and agreement will survive the cancellation or termination of your participation in the Program.

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD US, OUR AGENTS, AND ANY THIRD-PARTY SERVICE PROVIDER WE USE TO SEND TEXT MESSAGES HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU PROVIDED. THIS INCLUDES, WITHOUT LIMITATION, CLAIMS OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227 ET SEQ., SIMILAR STATE OR FEDERAL LAWS, OR REGULATIONS PROMULGATED THEREUNDER RESULTING FROM OUR ATTEMPT TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

Program Description: Users who opt into the Program can expect to receive recurring committee, campaign, and donation messages concerning Our activities and their relationship with Us. These may include fundraising requests, campaign updates, volunteer opportunities, news, online events, and media appearances.

Cost and Frequency: Message and data rates may apply. The Program involves recurring mobile messages. Message frequency varies, and additional messages may be sent periodically based on your interactions with Us.

Support Instructions: For Program support, text HELP to 57282 or email Us at info@electdem.io.

MMS Disclosure: If your mobile device does not support MMS messaging, the Program may send an SMS message instead.

Disclaimer of Warranty: The Program is provided on an “as-is” basis. It may not be available in all areas or at all times and may cease to function because of product, software, coverage, or other changes made by your wireless carrier.

We are not liable for delays or failures in the receipt of mobile messages connected with the Program. Delivery is subject to effective transmission by your wireless service provider or network operator and is outside Our control. T-Mobile is not liable for delayed or undelivered mobile messages.

Age Restriction: You may not use or engage with the Program if you are under thirteen (13) years of age. If you are between thirteen (13) and eighteen (18) years of age, you must have permission from your parent or legal guardian.

By using or engaging with the Program, you acknowledge that you are either of adult age in your jurisdiction or are at least thirteen (13) years old and have the required permission from your parent or legal guardian. You also acknowledge that you are permitted by applicable law to use and participate in the Program.

Truthful and Accurate Information: When you complete online forms or otherwise provide information to Us in connection with the Program, you agree to provide accurate, complete, and truthful information. You agree not to use a false or misleading name or a name you are not authorized to use.

If, in Our sole discretion, We believe that the information provided is untrue, inaccurate, or incomplete, or that you joined the Program for an improper purpose, We may refuse you access to the Program and pursue any appropriate legal remedies.

Mobile Messaging Privacy Policy

We respect your privacy. This Mobile Messaging Privacy Policy describes the personal information We collect or receive when you participate in the Program, how We use or disclose that information, and the rights that may be available to you.

This Mobile Messaging Privacy Policy applies to personal information collected, used, or shared by Us in connection with the Program. It is limited to the Program and does not modify any other privacy policy governing your relationship with Us in other contexts.

Information We Collect and How We Use It

The personal information We may collect includes your name, telephone number, email address, and marketing preferences. We may also collect information indicating whether a message was delivered to or read by you, along with related messaging data.

We may use this information to:

  1. Provide and administer the Program and related support;
  2. Deliver information about Our activities, campaigns, fundraising efforts, and promotions;
  3. Improve the Program and Our services;
  4. Prevent fraud and comply with applicable laws; and
  5. Protect the security and integrity of Our systems.

We may combine personal information obtained through your participation in the Program with other online or offline information We maintain about you.

When We Share Your Information

Information you provide through the Program may be shared with third parties for the purposes described in Our general privacy policy, available at https://electdem.io/privacy-policy/.

However, text messaging originator opt-in data and consent will not be shared with or sold to third parties for their own marketing purposes. We may share this information with Our text messaging platform provider, wireless carriers, or other trusted service providers when necessary to operate the Program and send you messages under these Terms.

We reserve the right to disclose information when necessary to comply with a law, regulation, court order, or governmental request; avoid liability; or protect Our rights, property, users, or the public.

Contact Us

To exercise any rights related to your personal information or ask questions about these Terms, you may contact Us using one of the following methods:

Your Privacy Rights

Depending on the state where you live, you may have certain rights regarding your personal information. These may include the right to request information about Our collection and use of your personal information, request the correction of inaccurate or outdated information, or request the deletion of personal information We collected and retained, subject to exceptions permitted by law.

When applicable, We will process and honor requests as required by law. We may deny a request when permitted by applicable law.

Dispute Resolution

If a dispute, claim, or controversy arises between you and Us, Our third-party text messaging platform provider, or another service provider acting on Our behalf to transmit messages under the Program, and the matter arises from or relates to federal or state statutory claims, common-law claims, these Terms, or the breach, termination, enforcement, interpretation, or validity of these Terms—including the scope or applicability of this arbitration agreement—the dispute will, to the fullest extent permitted by law, be resolved through arbitration in Washington, DC, before one arbitrator.

The parties agree to submit the dispute to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. Except as otherwise provided in these Terms, the arbitrator will apply the substantive laws of the federal judicial circuit in which Our principal place of business is located, without regard to its conflict-of-laws rules.

Within ten (10) calendar days after an arbitration demand is served, the parties must jointly select an arbitrator with at least five (5) years of experience serving in that capacity and with knowledge of the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, either party may ask the AAA to appoint an arbitrator who satisfies the same experience requirements.

The arbitrator will determine the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties agree that the AAA rules governing Emergency Measures of Protection will apply instead of seeking emergency injunctive relief from a court.

The arbitrator’s decision will be final and binding. No party will have a right to appeal except as provided under Section 10 of the FAA. Each party will bear its share of the arbitrator’s fees and the costs of administering the arbitration. The arbitrator may, however, require one party to pay some or all of those fees as part of a reasoned decision.

The arbitrator may award attorneys’ fees only when expressly authorized by statute or contract. The arbitrator will have no authority to award punitive damages, and each party waives any right to seek or recover punitive damages in an arbitration.

The parties agree to arbitrate solely on an individual basis. This agreement does not permit class arbitration or claims brought in a representative capacity or as a plaintiff or class member in a class proceeding.

Except as required by law or as necessary to protect or pursue a legal right, neither a party nor the arbitrator may disclose the existence, content, or outcome of an arbitration without the prior written consent of both parties.

If any provision of this section is invalid, illegal, or unenforceable in a particular jurisdiction, that determination will not affect any other provision or render the provision unenforceable in another jurisdiction.

If a dispute proceeds in court rather than arbitration, the parties waive any right to a jury trial. This arbitration provision will survive the cancellation or termination of your participation in the Program.

Miscellaneous

You represent and warrant that you have all rights, power, and authority necessary to agree to these Terms and perform your obligations under them. You further represent that entering into these Terms and performing your obligations will not breach another contract or obligation.

A party’s failure to exercise a right provided under these Terms will not be considered a waiver of that or any other right. If any provision is found to be unenforceable or invalid, it will be limited or eliminated to the minimum extent necessary so that the remaining provisions continue in full force and effect.

Any new features, changes, updates, or improvements to the Program will be subject to these Terms unless expressly stated otherwise in writing.
